Terms of service
Who you are buying from. Rambler Safety ("Rambler", "we", "us") sells safety footwear and workwear in South Africa through this website. You can reach us at support@ramblersafety.com, on WhatsApp 074 697 3907, or on 061 609 6915. These terms, the delivery policy, the returns and exchanges policy and the privacy notice together govern every order placed here. By placing an order you accept them. Nothing in them takes away a right you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
Orders and acceptance
An order is an offer to buy. We accept it when payment is confirmed (by Payfast for card and instant EFT, or by the bank for a direct transfer) and we email you the order reference. Until then no contract exists and we may decline an order, for example where a size has sold out between the page loading and payment arriving; in that case anything paid is refunded in full within 7 days.
Under section 44 of the Electronic Communications and Transactions Act you may review and correct an order before it is placed: the basket and the checkout show every line, size, quantity, delivery charge and the total to pay before you confirm.
Prices and payment
Prices are in South African rand and are the prices shown at the time you order. Rambler is not registered for VAT, so no VAT is charged or shown. Delivery is charged separately and shown before you pay. Payment is taken by Payfast (Visa, Mastercard, instant EFT and the other methods Payfast offers); your card details are entered on Payfast's secure page and never reach our servers. An obvious pricing error (for example a boot listed at R7.50) does not bind us; we will tell you and offer the correct price or a full refund.
Stock and availability
Stock shown on a product page is our best current count, updated from our stock system through the day. The final check happens at checkout. If a size cannot be supplied after payment we will offer another size or colour, a delay, or a full refund, at your choice.
Delivery
We deliver anywhere in South Africa by courier as set out in the delivery policy. Risk in the goods passes to you on delivery to the address you gave. Please check the parcel and tell us within 48 hours if anything is damaged or missing.
Returns, exchanges and cooling-off
Wrong size? Unworn pairs in their original box are exchanged within 7 days of delivery, as set out in the returns and exchanges policy. Because you buy at a distance, section 44 of the Electronic Communications and Transactions Act also gives you the right to cancel an order within 7 days of delivery and receive a refund of the purchase price; the direct cost of returning the goods is yours. Goods that are defective, unsafe or not what was described are covered by the Consumer Protection Act's six-month implied warranty: tell us, with a photograph where possible, and we will repair, replace or refund.
Safety footwear
Where a product page states an NRCS or SABS approval, that approval applies to that style as manufactured; we state each product's own certification and never a brand-wide one. Safety footwear protects only when it fits and is worn as intended; choose the size with the size guide, and inspect the pair before each use.
Your account and our website
You may buy as a guest. If you create an account you are responsible for keeping the password private. Trade accounts, trade pricing and account terms are agreed separately in writing and are not offered through the public shop. You may not use this site to scrape prices, place orders you do not intend to pay for, or interfere with its operation.
Liability
To the extent the law allows, our liability for any order is limited to the price paid for it. Nothing in these terms limits liability for death or personal injury caused by our negligence, for gross negligence, or any liability that cannot be excluded under the Consumer Protection Act.
Privacy
How we handle your personal information is set out in the privacy notice, which forms part of these terms.
Complaints and the law
If something has gone wrong, write to support@ramblersafety.com and we will answer within two working days. You may also approach the Consumer Goods and Services Ombud or the National Consumer Commission. These terms are governed by the law of the Republic of South Africa. Where a court finds one clause unenforceable, the rest stand.
